Balance Sheet of Anti-trust Legislation

What summary statements may be made about almost a hundred years of governmental effort—by the Congress, the President, and the Department of Justice, by federal courts and by the United States Supreme Court—to regulate and control the evolution of corporate organization and enterprise? What success has our sociocultural system, the United States, had in overcoming the traditional—and semi-sacred, at least—doctrines and practices of laissez faire?

It will not be difficult to state what, in general, the verdict has been. Our sociocultural system is not homogeneous; on the contrary difference and conflict of interest is one of its dominant characteristics. And the issue has been a simple one: laissez faire or regulation and control. On the one hand, we would expect some observers to declare that antitrust legislation and judicial decisions—the noble effort to preserve freedom in business enterprise and democracy among entrepreneurs—have been effective. On the other hand, we would expect to hear the plaintive wail of the little businessman who feels that his interests have not been adequately protected. In reviewing the history of this contest one encounters contradictions in the testimony, real or apparent. But this is to be expected, also; observers judge—and even see—events from different vantage points or prejudices. Yet, had it not been for anti-trust and similar laws in the United States, conditions would have been much worse.
